Cellport Defends Its Patented 2-Part Personal Telematics Architecture;
Files Lawsuit against THB Bury


Jan. 7, 2004/Boulder, CO:  Cellport Systems, creator of the world-wide wireless phone Personal Telematics patent portfolio, has filed a lawsuit against Bury GmbH & Co. KG and THB USA, Inc. of Coral Gables, FL  (doing business as THB Bury) alleging unauthorized use of Cellport's proprietary technology by THB Bury.

The legal action, filed January 6, 2004 in Maryland Federal court, seeks damages and an injunction prohibiting THB Bury from continued unauthorized use of Cellport's patented technology.

Cellport's patented 2-Part Personal Telematics architecture, licensed to five other companies in the US, Europe and Asia, connects multiple makes and models of portable wireless handsets with one standard vehicle interface for convenient hands-free use and other Telematics applications.  Interchangeable phone-specific pocket adaptors snap directly on the vehicle's built-in or installed system - becoming the link between the phone's capabilities and the vehicle's resources.

"We believe THB Bury is using our patented technology without appropriate licensing," said Pat Kennedy, CEO of Cellport Systems.  "In order to protect our patents and leadership in the Personal Telematics field, we have no choice but to enforce our intellectual property rights in court."

The company's patented Personal Telematics architecture merges a wireless handset's voice, data and entertainment capabilities into a vehicle, providing convenient hands-free operation by including a speaker, microphone, voice-activated dialing and external antenna.  The system also charges the phone and mutes the stereo/radio during a call.
